This repeal and readopt references the Centers for Medicare and Medicaid Services and State Fire Marshal's authority as they apply to health care facility design and construction in Section R432-4-1.
This repeal and readopt adds Section R432-4-3, Incorporations by Reference, which outlines the external materials that the Office of Licensing (OL) will reference for the design and construction of health care facilities. Before a recent repeal and reenact, these IBRs existed in this rule, and OL received public comments in response to the previous repeal and reenact filing indicating that the removal of these materials would pose a safety risk to the populations served in health care facilities. As a result, the IBRs are being added back to this rule.
This repeal and readopt redefines licensee to include an applicant to avoid repetitive wording and aligns terminology with other OL construction rules without altering this rule's content.
Other changes align terminology and content by removing those items from individual construction rules and placing only content applicable to all construction in Sections R432-4-16 through R432-4-22, thus freeing up individual rules for content specific only to that facility type.
Additionally, this repeal and readopt makes style and formatting changes to comply with the Rulewriting Manual for Utah and align this rule with other rules under the department.
This repeal and readopt does not introduce any new requirements for licensees but consolidates requirements into a single rule.
The department's Health Care Facility Licensing Committee has approved this rule repeal and readopt filing.
