This filing updates language for consistency of terms used in this and other rules.
This filing adds definitions for "budget adjustment threshold" and "funding misalignment threshold" to allow the division greater flexibility in making dollar amount adjustments to these variables, which are frequently updated, in division policy rather than in rule.
Definitions for "committee" and "committee chair" have been removed because that information already exists in division policy.
Definitions have been added for "request for services determination" or "RFS determination," "request for services meeting" or "RFS meeting," "request for services program administrator" or "RFS administrator," and "request for services team" or "RFS team" to align with recent changes to division policy.
The term "request for services team" replaces the term "request for services committee" throughout this rule to more accurately reflect that there is not a single standing committee but, rather, a variety of meetings that are held with different members of the RFS team to make decisions, as described in this rule and in division policy.
Accordingly, the terms "voting committee member" and "non-voting committee member" have been changed to "voting member" and "non-voting member.
A definition for the division case management system, "Utah System for Tracking Eligibility, Planning, and Services" or "USTEPS" has been added for consistency across division rule and policy.
The definition of "immediate jeopardy" has been replaced with a new definition for the term "imminent risk" for accuracy and to avoid a potential conflict with the meaning of that term that appears in Centers for Medicare and Medicaid Services (CMS) guidance on "immediate jeopardy" in clinical settings.
Section R539-12-3 has been shortened, simplified, and renamed to "Request for Services." Section R539-12-6 has also been revised and renamed to "Needs Adjustment Request" to reflect changes to terminology and procedure.
Other style and formatting changes bring this rule into alignment with the Rulewriting Manual for Utah and other rules under the department.
