B. Purpose of the new rule or reason for the change:

The Division of Outdoor Recreation (Division) has determined that a blanket rule requiring the use of personal flotation devices (PFDs) on nearly all rivers, subject to limited exceptions, does not adequately inform the public which waterways present heightened risks warranting a mandatory wear requirement.

When most rivers are regulated identically, the rule fails to distinguish between ordinary waterways and those possessing extreme, hazardous characteristics, such as swift currents, technical rapids, or limited opportunities for self-rescue. By identifying only those rivers or river sections where PFD wear remains mandatory, this rule more effectively signals elevated dangers to the recreating public and better promotes informed decision-making and compliance.

Second, in response to the increased usage of "non-standard watercraft" on Utah's waterways, the Division will now apply the PFD rules to "non-standard" watercraft being used to transport individuals on Utah's waterways as the Division applies them to vessels.

C. Summary of the new rule or change:

This amendment restructures the statewide PFD requirement applicable to Utah rivers and also expands the application of the rule to "non-standard watercraft."

Rather than maintaining a general requirement that individuals wear a PFD on most Utah rivers subject to limited exceptions, the amendment establishes non-use of a PFD as the general rule and identifies specific Utah waterways where PFD use remains mandatory.

As a result, the amendment eliminates existing PFD wear requirements for a substantial number of Utah waterways.

Secondly, the rule is now expanded to require those in a "nonstandard watercraft" to wear a PFD on the Mandatory PFD Sections. The Division notes here that this rule change has no impact on the PFD wear requirement for those 12-years-old and younger who are onboard a vessel.

R650-215-1. Definitions.

As used in this rule:

(1) "Non-standard watercraft" means, for the purposes of this rule, an inflatable device not primarily used for transporting individuals on

water, but nonetheless capable of transporting individuals across water. This definition includes items such as tire inner tubes, inflatable air

mattresses, and pool toys.

[(1)](2) "Personal flotation device" or "PFD" means a device that is:

(a) in serviceable condition; and

(b) approved by the Commandant of the United States Coast Guard pursuant to 46 CFR part 160.

[(2)](3) "Throwable PFD" means a PFD that is intended to be thrown to a person in the water.

(a) A PFD marked as Type IV or Type V, with Type IV performance, is considered a throwable PFD.

(b) Unless specifically marked otherwise, a wearable PFD is not a throwable PFD.

[(3)](4) "Vessel length" means the measurement of the permanent part of the hull, from bow to stern, across the deck down the centerline,

excluding sheer.

[(4)](5) "Wear" means to have a PFD properly worn with all fasteners connected.

[(5)](6)(a) "Wearable PFD" means a PFD that is intended to be worn or otherwise attached to the body.

(b) A PFD marked as Type I, Type II, Type III, or Type V, with Type I, II or III performance, is considered a wearable PFD.

R650-215-2. Type IV PFD Requirements.

(1) A person may not operate, or give permission to an individual to operate, a vessel that is between 16 feet and 40 feet in length unless there is at least one throwable PFD on board the vessel.

(2)(a) A person may not operate, or give permission to an individual to operate, a vessel that is greater than 40 feet in length unless there are at least two throwable PFDs on board the vessel.

(b) One of the PFDs required by Subsection (2)(a) must be a minimum 18" ring buoy type with at least 30 feet of rope attached.

(d) One of the PFDs required by Sub[j]section (2)(a) must be located near the stern of the vessel when the configuration of the vessel

allows for a PFD to be stored near the stern.

R650-215-3. Immediately Available and Readily Accessible.

(1) Unless a vessel passenger is required by law, rule, or regulation to wear a PFD, a vessel operator shall ensure:

(a) all Type IV PFDs that are onboard a vessel are immediately available for use by vessel passengers; and

(b) all other types of PFDs that are onboard a vessel are readily accessible to vessel passengers.

R650-215-4. Type V PFD Carried in Lieu.

A vessel operator or passenger may carry or wear a Type V PFD in lieu of another required PFD only if it is used according to the approval conditions on its label.

R650-215-5. [Whitewater River PFD Requirements.]Skimboard PFD Exception.

[On whitewater rivers, as defined in Subsection R650-206-2(1), a vessel operator shall carry Type I or Type III PFDs on board the vessel

and shall ensure all PFDs are used according to the approval conditions on their labels.]The PFD wear requirement does not apply to persons using a

skimboard on shallow waters within 50 feet of a Mandatory PFD Section's shoreline.

R650-215-6. Required Wearing of PFDs.

(1) A person may not use an inflatable PFD to meet the requirements of this section.

(2) All persons on board a personal watercraft, as defined in Section 73-18-2, shall wear a PFD.

(3) All persons on board a non-standard watercraft, as defined in Section R650-215-1, on the Mandatory PFD Sections described in

Section R650-215-7, shall wear a PFD.

[(3)](4) The operator of a vessel under 19 feet in length shall ensure each passenger 12 years of age or younger wears a PFD at all times

while onboard the vessel.

[(4)](5) The operator of a vessel 19 feet or more in length shall ensure each passenger 12 years of age or younger wears a PFD at all times

while onboard the vessel, except when the passenger is inside a cabin area.

[(5)](6) [On every river, every person on board a vessel shall wear a PFD, except that a PFD may be loosened or removed by a person 13

years of age or older on designated flat water river sections as listed in Section R650-215-10.]Every person on board a vessel on Mandatory PFD

Sections described in Section R650-215-7 shall wear a PFD.

[R650-215-7. Designated Flatwater River Sections.

(1) Flatwater river sections on the Green River extend:

(a) from Red Creek Camp, below Red Creek Rapids to the Indian Crossing Boat Ramp;

(b) from 100 yards below Taylor Flats Bridge to the Utah or Colorado state line in Browns Park;

(d) from the mouth of Split Mountain to Jack Creek in Desolation Canyon; and

(e) from the Green River Diversion Dam, below Gray Canyon, to the confluence with the Colorado River.

(2) Flatwater river sections on the Colorado River extend:

(a) from the Colorado or Utah state line to the Westwater Ranger Station;

(b) from Big Hole Canyon in Westwater Canyon to Onion Creek;

(d) after the last active rapid in Cataract Canyon.

(3) Flatwater river sections on the San Juan River extend from after the last active rapid before Lake Powell to Lake Powell.]

R650-215-7. Mandatory PFD Sections.

(1) The following water bodies are designated as a Mandatory PFD Section in their entirety:

(a) Bear River;

(b) Dirty Devil River;

(d) Escalante River;

(e) Fremont River;

(f) Huntington Creek;

(g) Jordan River; and

(h) Price River.

(2) The following sections of water bodies are designated as Mandatory PFD Sections:

(a) a section of the American Fork River starting at the Swinging Bridge Picnic Area and ending at the mouth of American Fork Canyon;

(b) a section of the Big Cottonwood Creek starting at the creek's intersection with Wasatch Blvd. Bridge and ending at the creek's

confluence with the Jordan River;

(c) a section of the Blacksmith Fork Creek starting at the creek's intersection with Ant Flat Road and ending at the Hyrum Upper Power

Plant;

(d) a section of the Cottonwood Creek, also known as "Lower Seeley Creek", starting at Joes Valley Reservoir and ending with the creek's

intersection with the North Main Street bridge in Orangeville;

(e) a section of the Little Cottonwood Creek starting at Temple Quarry Trailhead and ending at the creek's confluence with the Jordan

River;

(f) a section of the Logan River starting at Rick's Springs and ending at Third Dam;

(g) a section of the Muddy Creek River starting at the South Salt Wash launch ramp and ending at the river's confluence with the Dirty

Devil River;

(h) a section of the Ogden River starting at the Pineview Dam and ending at the river's confluence with the Weber River;

(i) a section of the Paria River starting at the river's intersection with U.S. Highway 89 and ending at the boundary between Utah and

Arizona;

(j) a section of the Provo River starting at the Deer Creek Dam and ending at the Murdock diversion dam;

(k) a section of the San Juan River starting at the boundary between Utah and Colorado and ending at the last active rapid upstream of

Lake Powell;

(l) a section of the San Rafael River starting at the San Rafael Campground Bridge and ending with the river's intersection with Interstate

70; and

(m) a section of the Weber River starting at the river access point located near the milepost 112 Interstate 84 interchange and ending at the

river's confluence with the Ogden River.

(3) The following sections of the Colorado River are designated Mandatory PFD Sections:

(a) the section starting at the Westwater Boat Launch and ending at Big Hole Canyon located near Westwater Canyon;

(b) the section starting at Lower Onion Creek Boat Ramp and ending at Drinks Canyon; and

(c) the section starting at the confluence of the Green River and Colorado River and ending after the last active rapid in Cataract Canyon.

(4) The following sections of the Green River are designated Mandatory PFD Sections:

(a) the section starting from the Flaming Gorge Dam and ending 100 yards downstream from Taylor Flats Bridge;

(b) the section starting at the boundary between Utah and Colorado located in Uintah County and ending at the mouth of Whirlpool

Canyon within Dinosaur National Monument;

(d) the section starting at Jack Creek in Desolation Canyon and ending at the Green River Diversion Dam located downstream of Gray

Canyon.

A person shall use a PFD according to the conditions or restrictions listed on the PFD's U.S. Coast Guard Approval Label.
